How do we keep your information safe? We have technical and organizational security measures in place. However, no internet transmission can be guaranteed 100% secure.

What are your rights? Depending on where you are located, applicable privacy law may give you rights including access, correction, deletion, and the right to withdraw consent. The Saint Lucia Data Protection Act 2011 applies to our processing.

1. What information do we collect?

We collect personal information that you voluntarily provide to us when you register on the Services, participate in activities on the Services, or otherwise contact us. The categories of personal information we collect depend on the context of your interactions with us and the Services.

Personal Information Provided by You may include:

Identity Verification Data. To verify the identity of service providers, we use a third-party identity verification service, Persona Identities, Inc. When you sign up as a provider, you will be asked to provide a government-issued photo ID (passport, driver's license, or national ID), a live selfie or short video used for biometric face-match against the ID, and supporting documents as required by applicable regulations. This data is collected and processed by Persona on our behalf. Persona stores the verification data in their systems; Avail receives only the verification outcome and limited metadata (verification timestamp, document type, last four of ID number where applicable). Biometric data is sensitive personal information; we process it based on your explicit consent given at verification and on our legitimate interest in preventing fraud and meeting regulatory obligations.

Sensitive Information. With your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

Payment Information. When you make a payment on our platform, your card details are entered directly into a Hosted Payment Page provided by our payment processor, PowerTranz (operated by First Atlantic Commerce). Your full card number, CVV, and expiry are transmitted directly to PowerTranz and never touch Avail's servers — we operate under PCI DSS SAQ A scope, meaning we do not store, process, or transmit cardholder data. We receive only a payment confirmation token, the last four digits of your card, the card brand, and the transaction outcome. Payout Information for Providers. To receive payouts, providers must provide bank account details. We collect the full account number once at the time you enter it, transmit it securely via our email service provider (SendGrid) to our payout-processing workflow, and then immediately clear the full number from our systems. We retain only the last four digits of the account number for reference and reconciliation.

Apple Sign-In and Google Sign-In Data. If you choose to register or log in using Apple Sign-In or Google Sign-In, we receive limited profile information from those providers (your name, email address or a private relay email if you choose to hide it through Apple, and — for Google — your profile picture and Google account ID). We use this information solely to create and maintain your account.

When we use Google Maps Platform APIs

We may share your information with Google Maps Platform APIs (e.g., Google Maps API, Places API) to provide map display, address autocomplete, and routing features. Google Maps uses GPS, Wi-Fi, and cell towers to estimate location, with accuracy varying by environment. We obtain and store on your device ("cache") your location to support these features. You may revoke this consent at any time by contacting us or by disabling location access in your device settings.

We may disclose your information if required by law, in response to lawful requests by public authorities, or to protect our rights and the rights of others. We may also share or transfer your information in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business.

We retain account and personal information for the duration of your active account plus seven (7) years following account termination, to comply with applicable financial, tax, anti-money-laundering, and KYC record-keeping obligations. Some data may be retained longer where required by law. When retention periods expire, we will delete or anonymize the relevant information.

10. Controls for do-not-track features

At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT signals or any other automatic tracking-preference mechanism.
